1. Scope

These General Terms and Conditions apply to all orders placed through the online shop at www.novosoxx.com with:

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

A trader is a natural or legal person, or a partnership with legal capacity, who acts in the course of their trade, business or profession when entering into a legal transaction.

2. Formation of the Contract

The presentation of products in the online shop constitutes a binding offer to conclude a purchase contract on the terms stated for each product.

You may initially place the products you want in the basket without obligation and review or amend your entries at any time before submitting the order.

By clicking the final order button, you accept the offer for the products in your basket and the purchase contract is concluded. Immediately after submitting the order, you will receive an order confirmation by email.

If you use an offered instant payment method, payment may be processed by the relevant payment service provider. The terms of the selected payment service provider also apply.

3. Prices and Payment Terms

All prices shown in the online shop are total prices and include statutory VAT.

Any additional shipping costs are shown in the online shop and no later than before the order is completed.

The available payment methods are shown during checkout. Unless otherwise stated for the selected payment method, the purchase price is due immediately when the contract is concluded.

4. Delivery

Delivery is available to the destinations offered during checkout and is made to the delivery address provided by you.

The applicable delivery times and shipping costs are displayed in the online shop or during checkout.

If an ordered product is exceptionally unavailable, we will inform you without undue delay. Any payment already made for unavailable products will be refunded.

For consumers, the risk of accidental loss of or damage to the goods passes only when the goods are handed over to you or to a person authorised by you to receive them.

5. Retention of Title

The goods remain our property until payment has been made in full.

6. Right of Cancellation

Consumers have a statutory right of cancellation. Information about exercising this right, the cancellation period and the effects of cancellation is provided in our separate Cancellation Policy.

Our additional voluntary 100-day returns policy does not affect the statutory right of cancellation or statutory rights relating to defective goods. The conditions of the voluntary returns policy are set out in our Returns Policy.

7. Liability for Defects

Statutory rights relating to defective goods apply.

If the goods delivered are defective, you can contact us at contact@novosoxx.com.

Our voluntary Anti-Hole Guarantee applies in addition to your statutory rights relating to defective goods. It does not restrict those rights. The requirements and scope of the guarantee are set out in the separate guarantee terms.

8. Contract Text and Contract Language

Your order details will be sent to you by email after the order has been completed.

Before submitting your order, you can save the order details and these General Terms and Conditions using your browser’s print and save functions.

The contract language is German. An English translation of these contractual terms is provided for convenience. In the event of any discrepancies, the German version prevails to the extent permitted by law.

9. Applicable Law

The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.

If the customer is a merchant, a legal entity under public law or a special fund under public law, the registered office of NovoSoxx GmbH is the place of jurisdiction for all disputes arising from the contractual relationship.

10. Consumer Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

11. Voluntary Anti-Hole Guarantee

In addition to the statutory rights relating to defective goods, NovoSoxx GmbH provides a voluntary Anti-Hole Guarantee for NovoSoxx socks purchased directly through the online shop at www.novosoxx.com.

The guarantee applies for six months from receipt of the goods and to orders with a delivery address within the European Union.

If a hole develops in the sock during normal, intended use within the guarantee period, NovoSoxx GmbH will replace the affected pair free of charge. If the same item is no longer available in the ordered size or colour, a comparable replacement will be agreed with the customer. There is no delivery charge for the replacement.

The guarantee does not cover damage caused by improper use or care, failure to follow the care instructions, sharp objects, external force, deliberate damage or loss. Cosmetic changes and normal signs of wear without a hole, such as pilling, discolouration or reduced elasticity, are also not covered.

To make a claim under the guarantee, the customer must email contact@novosoxx.com within the guarantee period and provide their name and order number. The email must include clear photographs showing the item and the hole.

A return is generally not required. If a return is exceptionally necessary for inspection, the customer will be informed in advance. In this case, NovoSoxx GmbH will cover the direct return shipping costs.

Consumers may exercise their statutory rights in respect of defects free of charge. These rights are not restricted by this guarantee. The Anti-Hole Guarantee applies in addition to these statutory rights.

A replacement does not extend or restart the guarantee period.
